The Police Federation of England and Wales (PFEW) relies upon section 43 of the Freedom of Information Act 2000 (“FOIA”). Namely that the disclosure of this information would be prejudicial to the commercial interests of the PFEW.  This position is taken on the basis that:

  1. The information sought would likely be used to the PFEW's detriment and therefore prejudice PFEW's position and commercial interests, in ongoing litigation against the PFEW.
  2. The PFEW considers there to be little public interest in disclosure of the net amounts transferred by the National Federation to branches. This information does not reflect the financial interactions between the National Federation and branches and therefore is of limited illustrative value. Against this, the PFEW considers that there is a strong public interest in it being able to litigate in the way that a normal litigant would be able to, without its position being impacted by its opponents having knowledge and seeking to make use of the information requested.
